Alexander R. Hess

Alex specializes in complex commercial litigation and insurance coverage litigation.  His complex commercial litigation practice has included disputes involving breach of contract, breach of fiduciary duty, business fraud, securities fraud, employment discrimination, defamation, tortious interference, and professional liability.  His insurance coverage litigation practice has included disputes involving construction defect, advertising injury liability, personal injury liability, professional liability, errors and omissions, and bad faith, under various types of commercial policies.

The following is a sampling of noteworthy matters in which Alex has obtained favorable judgments and settlements for RSG's clients:

  • Breach of Contract Litigation (Delaware) - RSG obtained a $31 million settlement (out of claimed damages of $35 million) in a lawsuit brought by its reinsurance company client against an insurance company for breach of contract, breach of warranty, and fraud arising out of a complex commercial transaction.
  • Breach of Contract Litigation (New York) - RSG's client, a London-based reinsurer, retained RSG on the verge of trial in a lawsuit it had brought against a domestic reinsurer for breach of representations and warranties in a corporate acquisition.  The client's previous counsel, a major national firm, had advised it to pay a multimillion dollar pre-trial settlement to resolve the defendant's $6 million counterclaim.  In the midst of trial, RSG obtained a $1 million dollar settlement in favor of its client and shielded its client from all liability on the counterclaim.
  • Breach of Contract Litigation (New York) - RSG obtained a $1 million settlement (out of claimed damages of $1.2 million) for its insurance company client in a breach of contract lawsuit against its third-party administrator.
  • Breach of Contract Arbitration (Illinois) - RSG obtained a $3 million award on behalf of its insurance company client in an arbitration based on alleged errors and omissions by the company's managing general agent.
  • Hotel Negligence Litigation (Connecticut) - RSG obtained a $2 million settlement for its client in a lawsuit based on allegations of negligence against a hotel.
  • Insurance Coverage Litigation (Maryland) - RSG obtained settlements on behalf of its insurance company client in several lawsuits seeking rescission of liability policies based on the insureds' alleged misrepresentations on their respective insurance applications.  As a result of these settlements, RSG's client reduced its exposure under the policies at issue by tens of millions of dollars.
  • Securities Fraud Litigation (Illinois) - In a securities fraud lawsuit in which the plaintiff alleged damages in excess of $2 million caused by RSG's client's alleged securities fraud, RSG negotiated a settlement under which its client paid only a small fraction of the plaintiff's claimed damages.
